2011 Avandia Settlements

Avandia Settlement
Diabetes drug maker GlaxoSmithKline has agreed to pay more than $700 million to settle about 12,000 Avandia lawsuit claims, and that is only the beginning. The lawsuits allege that GSK failed to warn patients about the diabetes drug’s increased stroke and heart attack risk. Several studies have linked Avandia use to an increased risk of heart attack, stroke, and congestive heart failure.
Avandia settlements in more than 1,000 case are expected soon according to an Avandia attorney representing plaintiffs on cases in Illinois, California, and Pennsylvania. Settlement talks in California already have resulted in 2,400 Avandia claims being resolved. The Avandia settlement amounts vary depending on the specific facts relating to the personal injury or wrongful death damages suffered in each case.
An Avandia recall in Europe was announced last September. The FDA fell short of ordering an Avandia recall, but issued tight new restrictions on the diabetes medication. Once the world’s best-selling diabetes drug, Avandia sales topped $3.2 billion in 2006. Glaxo has said that it no longer would promote the drug.

If you do not file your case in time, you may be barred forever from making an Avandia claim or receiving any compensation.
All states have statutes of limitations that determine the time period allowed to file an Avandia lawsuit. The applicable statute of limitation, or deadline to file claims, varies from state to state, and the personal injury statute of limitation deadline can be different from the wrongful death statute of limitation deadline within the same state.
For example, in some states a personal injury claim must be filed within 3 years from the date the Avandia-related disease or drug interaction is diagnosed, while a wrongful death claim must be filed within 2 years from the date of a death if caused by Avandia. In some states, the statutes of limitations may be as short as 1 year from the date of diagnosis or death.
Because of these varying deadlines, you should not delay seeking legal advice and legal representation if you have experienced an adverse side effect involving Avandia. Avandia
GlaxoSmithKline Plc, the maker of Avandia and the U.K.’s biggest drugmaker, said it will have fourth-quarter legal costs of 3.5 billion dollars because of a U.S. investigation into sales practices for certain products and product-liability cases related to the Avandia diabetes drug.
The company is setting aside additional provisions for the investigation by the U.S. attorney in Colorado into the company’s sales and promotional practices of certain products, London-based Glaxo said in an e-mailed statement today. The money also will cover for the “substantial” number of new claims filed in the U.S. regarding Avandia, Glaxo said.
Avandia Withdrawn
The company has stopped promoting Avandia worldwide after regulators said the treatment would be withdrawn from the market in Europe and sales would be limited in the U.S. because of an increased risk of heart attacks. Avandia was once the world’s best-selling diabetes drug.
The U.K. drugmaker has “now completed its assessment of these additional” Avandia cases and made “an estimate of likely future claims,” the company said. Glaxo didn’t say how many Avandia cases remain to be settled and that is a concern.
Avandia Colorado Investigation
The U.S. attorney in Colorado issued a subpoena in 2004 over Glaxo’s “sales and promotional practices relating to nine of its largest selling products,” the company said in its 2009 annual report. Federal prosecutors in Colorado are investigating whether Glaxo promoted the drugs for unapproved uses, the company said.
The investigation, which is nationwide in scope, also looks into ways that Glaxo potentially influenced doctors, including company-sponsored medical education programs, speaker events, advisory boards, speaker training programs, clinical studies and “related grants, fees, travel and entertainment.”
Glaxo hasn’t disclosed which products are the subject of the investigation. Alex Harrison, a spokeswoman for Glaxo, declined to comment in an e-mail.

An Avandia Lawsuit and your Doctor

There are other factors to consider. Taking Avandia in conjunction with other medication can also lead to issues.
Medications like steroids, nitrate drugs, seizure and thyroid drugs, and diuretics may increase the chance of side effects if you take them with Avandia. Family history is also a factor. If conditions like heart failure or high blood pressure run in your family, you could be at increased risk. These are all factors that should have been included on warning labels. If issues like these were not made clear, there could be groundsSide effects of Avandia
